SENATE RESOLUTION
|
|
|
BE IT RESOLVED by the Senate of the State of Texas, 81st |
|
|
Legislature, Regular Session, 2009, That Senate Rule 12.03 be |
|
|
suspended in part as provided by Senate Rule 12.08 to enable the |
|
|
conference committee appointed to resolve the differences on |
|
|
House Bill No. 1722 (proceedings that may be referred to and the |
|
|
powers of a criminal law magistrate in Bexar County) to consider |
|
|
and take action on the following matter: |
|
|
Senate Rule 12.03(1), is suspended to permit the committee |
|
|
to change text not in disagreement in SECTION 1 of the bill, in |
|
|
Subdivision (8), Subsection (a), Section 54.906, Government |
|
|
Code, to read as follows: |
|
|
(8) any other matter the judge considers necessary |
|
|
and proper, including a negotiated plea of guilty before the |
|
|
court. |
|
|
Explanation: This change is necessary to maintain the |
|
|
authority of a district judge in Bexar County to refer |
|
|
proceedings in criminal cases involving negotiated pleas of |
|
|
guilty to a criminal law magistrate. |
