LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 6, 2009

TO:
Honorable Lois W. Kolkhorst, Chair, House Committee on Public Health

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB40 by Corte (Relating to regulations on certain complementary and alternative health care services.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Title 3 of the Occupations Code by adding a chapter that would apply to providers of complementary and alternative healing methods, treatments, and therapies. A new subchapter would prohibit certain practices by these providers and would require certain disclosures be made to clients before providing services. The Department of State Health Services (DSHS) estimates that the bill would result in the referral of 30 additional cases related to Health and Safety Code violations per fiscal year to the Office of the Attorney General (OAG), who indicates that costs associated with these referrals could be absorbed within current resources. It is assumed that investigation costs related to the additional referrals could be absorbed by DSHS within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
