No significant fiscal implication to the State is anticipated.

The bill would amend Health and Safety Code, Section 481.104 by adding salvia divinorum including derivatives and extracts to Penalty Group Three of the Texas Controlled Substances Act. The bill would take effect on September 1, 2009.

The Department of Public Safety and the Department of State Health Services anticipate no significant fiscal impact to the agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
