The bill would provide requirements for new commercial wells that accept non-hazardous industrial wastes. The bill would require the Texas Commission on Environmental Quality (TCEQ) to adopt rules governing new commercial non-hazardous industrial waste wells for which a permit has not been issued on or before the effective date of the bill (September 1, 2009). The bill also would suspend the permitting process for any pending application for such wells until the rules adopted pursuant to this bill would take effect. The bill would provide that the adopted rules apply to every application for new commercial non-hazardous industrial wells that are pending on the effective date of the bill, but also provides that the TCEQ would be authorized allow an applicant with a pending application to amend the application to conform to the rules adopted as a result of the bill's passage.
Any costs to the TCEQ in implementing the provisions of the bill are not expected to result in a significant fiscal impact.
