LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 31, 2009

TO:
Honorable Tommy Merritt, Chair, House Committee on Public Safety

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB207 by Jackson, Jim (Relating to enforcement of commercial motor vehicle safety standards in certain counties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 644.101(c), Transportation Code, to authorize sheriffs in a county with a population of 250,000 or more and that borders the United Mexican States to apply for certification to enforce commercial motor vehicle safety standards. Under current statute, only counties with a population of 2.2 million or more are eligible to apply for this certification.

According to the Department of Public Safety, which provides the training and certification of law enforcement officers for enforcing these safety standards, costs could be absorbed within existing resources.

It is anticipated that applicable counties would pursue certification only if any costs involved could be absorbed within existing budgets.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
