April 13, 2009

TO:
Honorable Todd Hunter, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB299 by Dutton (Relating to mediation procedures in certain family law suits.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code relating to mediation procedures in certain family law suits.
The bill would provide that a court may refer a family law case to mediation only on the written agreement of the parties, which may be revoked by one of the parties at any time before the party enters into a binding mediated settlement agreement.  To the extent the bill would amend court procedures in family law cases, no significant affect on judicial workloads or fiscal implication to the State is anticipated.   The bill would take immediate effect if the bill receives two-thirds the vote of all members.  Otherwise, the bill would take effect September 1, 2009.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
