LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 6, 2009

TO:
Honorable Tommy Merritt, Chair, House Committee on Public Safety

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB384 by Burnam (Relating to the prevention of racial profiling by certain civilian employees of the Department of Public Safety.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Article 2.131, Code of Criminal Procedure, to specify that civilian employees of the Department of Public Safety may not engage in racial profiling in the course of their duties related to issuing a driver's license, commercial driver's license, or personal identification certificate.  The Department of Public Safety indicates it is already in compliance with the provisions of the bill and therefore implementing its requirements would pose no additional cost to the agency.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
