No significant fiscal implication to the State is anticipated.
The bill would amend the Government Code (Chapter 418) by requiring the Governor’s Divisions of Emergency Management (GDEM) to develop a state emergency management plan annex that addresses alternative electrical power for service stations during the first 120 hours immediately following a disaster. The bill would require service stations, to which the provisions of the bill applies, adopt and submit for GDEM’s approval an emergency management plan ensuring that if electric power from a utility is interrupted, the service station maintains the ability to operate fuel pumps, dispensing equipment, life-safety systems, and payment acceptance equipment within 72 hours of being considered safe to operate. The bill would take effect on September 1, 2009.
The Department of Public Safety (DPS) states additional FTEs would be required to implement the provisions of the bill. However, this analysis assumes any additional fiscal impact created by the provisions of the bill could be absorbed within DPS’ current appropriations.
