FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 17, 2009

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB458 by Leibowitz (Relating to limitations on the number of dogs at a residence in certain counties.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would authorize the commissioners court in certain counties to limit the number of dogs that an individual may keep at a residence located in a residential subdivision in the unincorporated area of the county. An exception would be made for a residence that is used by a registered animal rescue group on a determination by the county commissioners court that the neighborhood in which the residence is located does not operate an animal shelter.

Based on the population criteria, provisions of the bill would apply to Bexar, Tarrant, Dallas, and Harris counties only.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
