No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the funding for the continuing education of certain peace officers.

 

The bill would amend the Occupations Code, Section 1701 which would require local law enforcement agencies to report to the Comptroller not later than November 1 of the preceding calendar year to be eligible for an allocation of money under Occupations Code, Section 1701.157(a).  The bill requires the report to include the number of agency positions reserved and filled as of January 1 of the year the report is due.  The report should also include the percentage of money received by the agency on or before March 1 of the year preceding the year the report is due that was used by the agency before the date the money was received on or before March 1 of the year the report is due and the number of training hours received during the same period.  The bill requires the agency to comply with all applicable laws regarding the use of any money received on or before March 1 of the year preceding the year in which the report is due.  The bill would apply to allocations made on or after January 1, 2011.  The bill would take effect on September 1, 2009, and any allocations made before the effective date would be governed by the law in effect immediately before the effective date.

 

The Commission on Law Enforcement Officer Standards and Education and the Comptroller of Public Accounts state that the provisions in the bill would have no significant fiscal impact to their agencies.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
