LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 16, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB523 by Giddings (Relating to the contents of a receipt issued for payment of a good or service; providing a civil penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code to prohibit printing a person's driver's license number on a sales receipt or other sales payment document. A violation would be a civil penalty not to exceed $500 for each calendar month in which the violation occurs. The attorney general or the prosecuting attorney in the county in which the violation occurs may bring an action to recover the civil penalty imposed.

The bill would take effect January 1, 2010.

According to the Office of the Attorney General, costs associated with implementing provisions of the bill could be absorbed within existing resources.

Local Government Impact

It is assumed that costs associated with prosecuting cases at the county level could be absorbed within existing resources, and that revenue gain from imposing and collecting civil penalties would not be significant.
