LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 11, 2009

TO:
Honorable Royce West, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB527 by Leibowitz (Relating to the removal of an appointed emergency services district board member by a county commissioners court.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to establish the deadline for when an emergency services district, when requested by the commissioners court, would be required to submit a written report regarding the district's budget, tax rate, and debt service for the preceding year. The bill would  authorize a county commissioners court to remove an appointed board member of an emergency services district, except a member appointed to fill a vacancy in an elected board member position, for failure to give the report. The bill provides the procedures that the commissioners court would be required to follow. The bill would also repeal a subsection of statute, resulting in applicability of filing the report to also apply to a board of a district located wholly in one county.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
