HB543 by Raymond (Relating to prohibiting human cloning and other uses of human tissue by institutions of higher education; providing penalties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would ban human reproductive cloning while allowing most stem cell work to proceed. The bill also would prohibit use of oocytes in nuclear transplantation research unless the oocyte was donated voluntarily by and with the informed consent of the woman donating the oocyte. An institution of higher education may not purchase, sell, or transfer a a human occyte.

The bill also would impose penalties for violations, including loss of state funding and up to a $10 million civil penalty for each violation.

The University of Texas Health Science Center at Houston and The University of Texas Medical Branch at Galveston anticipate needing an Institutional Review Monitor and Research Administrator for both institutions to manage stem cell protocols and to monitor compliance; however, any additional costs are estimated to be absorbed withing current resources.

The bill takes effect September 1, 2009.
