LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 8, 2009

TO:
Honorable Patrick M. Rose, Chair, House Committee on Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB601 by Villarreal (Relating to licensing requirements of the Department of Family and Protective Services for certain facilities and homes providing child care.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the list of entities in Section 42.041(b), Human Resources Code, that are exempt from the Department of Family and Protective Services' child-care licensing requirements in Section 42.041(b) by repealing the section that limited certain exemptions to programs in counties with populations of less than 25,000. The bill would amend certain exemptions to include pre-kindergarten programs. DFPS indicates that any costs to implement the provisions of the bill could be absorbed within existing resources and that, since rules are not yet in place relating to the section that would be repealed, there would not be a significant decrease in state revenue from licensing fees.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
