LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

February 26, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB690 by Solomons (Relating to the right of a tenant to hold a landlord liable for falsely advertised square footage or amenities.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code and provide that a tenant may hold a landlord liable for falsely advertising the square footage or amenities of a dwelling. While this bill could increase actions taken by the Office of the Attorney General under the Deceptive Trade Practices and Consumer Protection Act, it is assumed that any additional costs associated with implementation of the bill could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
