LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 5, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB768 by Kolkhorst (Relating to the requirement that a new road ordered by the commissioners court of a county be laid out by a jury of view.), As Introduced

No fiscal implication to the State is anticipated.

The bill would repeal Section 251.054, Transportation Code, removing the requirement for a jury of view to be appointed to lay out a new road ordered by the county commissioners court.

Local Government Impact

Counties contacted regarding the impact of the bill reported that they have not utilized this type of action in numerous years and would therefore experience no fiscal impact. It is assumed that if a county were to have plans to lay out a new road, removal of the jury of view process would result in a savings.
