LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION
Revision 1

March 15, 2009

TO:
Honorable Todd Smith, Chair, House Committee on Elections

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB790 by Burnam (Relating to the counting of a provisional ballot cast by a voter in a precinct in which the voter does not reside.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would allow a provisional ballot to be accepted at a precinct outside the voter’s precinct if the voter is registered in the state.  Votes from provisional ballots outside the voter’s registered precinct would only count for an office or measure relating to a statewide election, or for an office or measure in the voter’s registered precinct.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. The fiscal impact to counties would vary depending on the number of persons voting as provisional voters in a district, and the number of additional election workers needed to process provisional ballots; however, those costs are not anticipated to be significant.
