LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 16, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB881 by Rodriguez (Relating to a residential tenant's right to rescind a rental application or lease agreement.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code and provide that a tenant has five days after receiving the key to a property to rescind a rental application or lease unless the tenant has been given a previous opportunity to inspect the premises. The provisions of the bill could increase the number of new complaints, investigations or cases by the Consumer Protection and Public Health Division of the Office of the Attorney General. However, it is assumed that any additional costs associated with new complaints or investigations could be absorbed within existing state resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
