LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 15, 2009

TO:
Honorable Burt R. Solomons, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB957 by Swinford (Relating to the eligibility of certain public officers to the legislature and prohibiting legislators from other public employment.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would prohibit any public or foreign lucrative office holder from serving in the legislature or applying for a place on the ballot as a candidate for the legislature during the term for which the person is elected or appointed. The bill indicates the ineligibility would apply for the entire office holder’s term and would not be affected by resignation or removal from office before the end of the term. The bill would prohibit members of the legislature from simultaneous employment with any public or foreign governmental agency, excluding notary publics; positions in the armed forces reserve of the United States; or positions on the state military forces other than those in the governor's military staff.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
