FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 9, 2009

TO:
Honorable John T. Smithee, Chair, House Committee on Insurance

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1021 by Deshotel (Relating to coverage under residential property insurance policies for certain losses incurred because of compliance with an emergency evacuation order.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code to include coverage under residential property insurance policies for certain losses incurred because of compliance with an emergency evacuation order. The Texas Department of Insurance (TDI) would need to update its rules to comply with the bill's requirements. Additionally, insurers would be file amended forms with the agency to note the change in coverage. Based on the analysis provided by TDI, any costs associated with the implementation of this bill could be absorbed within existing agency resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
