The bill would amend the Occupations Code relating to the finality of an administrative law judge's decision in a contested case involving disciplinary action against a physician. The bill would require the Texas Medical Board to dispose of the contested case by issuing a final order based on the administrative law judge's findings of fact and conclusions of law. According to information provided by the Texas Medical Board, the provisions of the bill may increase the workload of the State Office of Administrative Hearings (SOAH) to the extent that affected physicians choose to process their cases through SOAH, given the bill's provisions.
For the purpose of this analysis, it is assumed that any costs associated with the bill could be absorbed within the agency's existing resources.
