LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 27, 2009

TO:
Honorable Lois W. Kolkhorst, Chair, House Committee on Public Health

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1128 by McReynolds (Relating to certain corrective actions by the Texas Board of Nursing including a pilot program on deferred disciplinary action; providing corrective actions.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would authorize the executive director of the Board of Nursing to recommend a corrective action for a licensee who has violated board rule. The bill would require the Board of Nursing to determine the feasibility of conducting a pilot program to evaluate the efficacy and effect of board deferral of disciplinary action against a licensee. The bill would require the Board of Nursing to implement the program if it is determined to be feasible.

The Board of Nursing indicates it could absorb the costs associated with implementing the provisions of the bill within its current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
