The bill would amend the Family Code relating to a temporary order or orders for modification in a suit affecting parent-child relationships to allow a child 12 years of age or older to express to a court in chambers as defined by the provisions of the bill, a preference of primary residence. While a suit is pending for modifying an order, a court is not permitted to change the designation of the child’s primary residence, unless it is in the best interest of the child. The bill would repeal Section 153.008 of the Family Code.
The bill would take effect September 1, 2009.
