No fiscal implication to the State is anticipated.

The bill would amend the Family Code relating to a temporary order or orders for modification in a suit affecting parent-child relationships to allow a child 12 years of age or older to express to a court a preference of primary. While a suit is pending for modifying an order, a court is not permitted to change the designation of the child’s primary residence, unless it is in the best interest of the child.

 The bill would take effect September 1, 2009.
