No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to prohibit assisted living facilities from discharging or transferring facility residents, who are enrolled in the Medicaid community-based alternative program (CBA program), based on the facility's voluntary withdrawal from the CBA program.  The provisions of the bill would apply to residents residing in the facility on the day before the date the facility ceases to accept payment from the program.

The bill would apply only to an assisted living facility accepting payment from the CBA program on or after September 1, 2009.

The bill would take effect September 1, 2009.
