LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 16, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1226 by Leibowitz (Relating to right to vacate and avoid residential lease liability following the occurrence of certain criminal offenses or family violence.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code and provide for releasing a tenant from liability under a lease if the tenant was a victim of certain penal code offenses that were committed on the premise of the leased property or if the tenant was a victim of family violence. While the provisions of the bill could result in additional investigations by the Office of the Attorney General, it is assumed that any costs associated with implementation of the provisions of the bill could be absorbed within existing state resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
