No significant fiscal implication to the State is anticipated.
The bill would amend Section 47.09(a) of the Penal Code to provide a defense to prosecution with regard to gambling and other gaming on the tribal lands of federally recognized Indian tribes.
Assuming these Indian tribes conduct gaming on their tribal lands, both the Lottery Commission and the Racing Commission estimate that there could be reduced revenue to the state from their games due to increased competition in the state.
The Comptroller's Office estimates that any fiscal impact to the state cannot be determined.
The bill would take effect September 1, 2009.
