The bill would prohibit a person younger than 16.5 years of age from using a tanning device. It also would not allow a person younger than 18 to use a tanning device unless the person's parent or legal guardian consents in writing (in person at the facility) that the person may use the tanning device. The person and the parent must sign and date that they have read and understand the advisory statement on indoor and outdoor tanning issued by the Texas Medical Board and agree that the minor will use protective eyewear at all times while using the tanning device.
No later than January 1, 2010 the Texas Medical Board shall adopt an advisory statement warning of the dangers of indoor and outdoor tanning and its association with skin cancer, eye damage, and other health risks. The executive commissioner of the Health and Human Services Commission shall adopt rules as prescribed by the bill.
It is assumed that any cost associated with implementing this bill can be absorbed within existing resources.
