LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 29, 2009

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1313 by Giddings (Relating to the assignment of a public school student to an inexperienced or uncertified teacher.), As Introduced

No fiscal implication to the State is anticipated.

The bill would prohibit school districts from assigning students in grades kindergarten through 6 for two consecutive years to teachers with less than one year of experience or who are not appropriately certification.

The bill would prohibit school districts from assigning students in grades seven through 12 for two consecutive years in courses subject to state assessment to teachers with less than one year of experience or who are not appropriately certification.

In either case, the prohibition does not apply if a parent or guardian and a counselor or school administrator agree that the assignment is appropriate.

Local Government Impact

To the extent that school districts may be required to reassign less experienced teachers and hire additional experienced teachers to comply with the provisions of the bill, local costs may be incurred and would vary.
