No fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to authorize a school district to institute and prosecute suits without giving security for cost and to appeal from judgment without giving supersedeas or cost bond. The provisions of the bill would apply only to a suit or an appeal filed on or after the effective date of the bill, which would be September 1, 2009.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. Fiscal implications would depend on the number of suits. Revenue losses to the courts would be equivalent to savings for the school districts.
