No significant fiscal implication to the State is anticipated.

The bill would amends the Health and Safety Code and the Occupations Code to clarify the regulation and license requirements of funeral homes, cemeteries, and crematories.  The bill would require the Texas Department of Banking to provide a list of perpetual care cemeteries to the Funeral Service Commission no later than January 1, 2010.  The bill would allow the Funeral Service Commission to adopt rules, establish procedures, and create forms to enforce and administer the provisions of the bill.  The Funeral Service Commision and the Texas Department of Banking indicate that any costs associated with the bill could be absorbed within each agency's existing resources.
