FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 1, 2009

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1507 by Bolton (Relating to authorizing certain populous counties to adopt noise regulations; providing criminal and civil penalties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add Subchapter D to Chapter 240, Local Government Code, to authorize Bexar, Dallas, Harris, Tarrant, and Travis counties to adopt regulations to regulate noise levels in the unincorporated area of the county. Provisions of the bill establish procedures for adopting the regulations and the parameters within which the counties would be authorized to regulate levels. A violation of the noise regulations would be a misdemeanor offense punishable by fine, imprisonment, or both as provided by the commissioners court. The commissioners court would also be authorized to provide civil penalties. Other legal actions could also be taken.

Regulations under the subchapter would not apply to land under the control, administration, or jurisdiction of a state or federal agency; however, they would apply to privately owned land when leased to a state agency.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
