LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 9, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1701 by Laubenberg (Relating to the regulation of certain activities on a public highway or road, the right-of-way of a public highway or road, or a parking lot.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Section 285.001 of the Transportation Code to authorize a county commissioners court to, by order, regulate roadside vendors and solicitors in the unincorporated area of the county if they occur on a public highway or road, in the right-of-way of a public highway or road, or in a parking lot.

Under current statute, Section 285.001 applies only to a county with a population of more than 1.3 million. The proposed change in statute would authorize any county to impose regulations as listed in the bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
