April 16, 2009

TO:
Honorable Todd Hunter, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1709 by Martinez, "Mando" (Relating to the random assignment of criminal and civil cases in district courts in Hidalgo County.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the random assignment of criminal and civil cases in district courts in Hidalgo County. The bill would require the district clerk of Hidalgo County to use an automated system for the assigning and docketing of cases in district courts in Hidalgo County. To the extent the bill would amend the manner in which the district clerk assigns cases, the change is not anticipated to increase the workload of the Hidalgo County courts. The bill would take effect September 1, 2009.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. According to the district clerk of Hidalgo County, the county already has an automated system; therefore, no fiscal impact to the county is anticipated.
