LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 31, 2009

TO:
Honorable Pete Gallego, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1721 by Bohac (Relating to taking or attempting to take a weapon from an employee or official of a correctional facility that is operated by a county or municipality.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code to add employees or officials of certain correctional facilities operated by a county to the list of those for whom taking a weapon from or attempting to take a weapon from is punished under 38.14, Penal Code.

The bill would take effect September 1, 2009 and apply only to an offense committed on or after the effective date of the Act.

For this analysis it is assumed the number of offenders convicted under this statute would not
result in a significant impact on the programs and workload of state corrections agencies or on the
demand for resources and services of those agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
