LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 22, 2009

TO:
Honorable John T. Smithee, Chair, House Committee on Insurance

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1748 by Smith, Todd (Relating to the cancellation of a health benefit plan on the basis of misrepresentation or a preexisting condition; providing penalties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code to limit a health benefit plan's cancelation policy on the basis of misrepresentation or a preexisting condition. The bill would also require the Texas Department of Insurance (TDI) to adopt rules relating to the changes in statute. TDI indicates it could absorb the costs associated with the bill within its current resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
