No significant fiscal implication to the State is anticipated.

The bill would allow a retail public utility, at the request of a school district, hospital or a hospital district that has a facility inside another retail public utility’s certificate of convenience and necessity (CCN) service area and that is within 100 kilometers of an international border, to provide supplemental utility service to the facility if the CCN holder’s service is inadequate or interrupted. In such instances, a CCN amendment application would not be required. The bill also would require the retail public utility providing the supplemental utility service to ensure that its water and/or sewer lines or facilities to provide the supplemental service do not interfere with the CCN holder’s facilities or ability to provide service to the area. It also would require the retail public utility providing the supplemental service to notify the Texas Commission on Environmental Quality (TCEQ) at the time the service is extended. No significant increase in the TCEQ's workload is expected as a result of the bill's passage.
