LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 30, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1826 by Smith, Todd (Relating to the release of certain motor vehicle accident report information.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to set the fee for a copy of an accident report or accident information at $6, rather than whichever is less of $6 or the actual cost of the preparation of the copy. The bill would allow the release of aggregated or statistical information relating to motor vehicle accidents so long as the information released is not personal information or would allow the identification of a specific accident. The bill would specify certain information that my not be released in the reports. The bill would set the fee for the release of aggregated or statistical information at the actual cost of preparing the information.

Based on the analysis of the Texas Department of Transportation, it is assumed any costs and duties associated with implementing the provisions of the bill could be absorbed within existing resources, and the costs of releasing accident report information would be offset by fees.

Local Government Impact

No fiscal implication to units of local government is anticipated.
