The bill would amend the Government Code by requiring the Texas Department of Criminal Justice (TDCJ) to annually test an offender for human immunodeficiency virus (HIV) who does not have a record of a positive test result and who has not undergone testing during the last calendar year. The bill would require TDCJ to adopt a policy that provides for the distribution of condoms through a health care provider at each facility and a nonprofit or public health care agency. TDCJ has estimated that costs associated with annual HIV tests would be approximately $828,000 (approximately 90,000 HIV tests per year x $9.20 per test). The Texas Department of Criminal Justice has determined that the cost of implementing the bill would not be significant.
