The bill would amend the Human Resources Code to prohibit programs or facilities operated or regulated by the Department of Aging and Disability Services (DADS) from transporting aged or disabled clients using a 15-passenger van that was purchased by the program or facility on or after September 1, 2009. Under the provisions of the bill, any inspections of the program or facility would also have to include an inspection of each motor vehicle used by the program or facility to transport its clients and each contract entered into by DADS for transportation services for aged or disabled clients would have to comply with the provisions .
Not later than November 1, 2009, the executive commissioner of the Health and Human Services Commission would be required to adopt rules applicable to each program or facility operated or regulated by the DADS.
The bill would take effect immediately if it received a vote of two-thirds of all the members elected to each house. If the bill does not receive the vote necessary for immediate effect, the bill would take effect September 1, 2009.
According to DADS, the bill would have no significant fiscal impact.
