HB1976 by Solomons (Relating to the operation of property owners' associations.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Property Code to allow a member of a property owners' association to bring a civil action against the association for violations of Chapter 202 to seek injunctive relief, damages in amounts set forth in the bill, or both. The court would be authorized to increase an award of damages in an amount not to exceed three times the amount awarded under Section 202.013(b)(2) based on certain findings of the court.

All other portions of the bill would apply only to a property owners' association, which is not a government entity.


Local Government Impact

It is anticipated that any additional cases brought before a court under the provisions of the bill could be absorbed within existing resources.
