No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure relating to a right of a close relative to seek expunction of arrest records and files on behalf of a deceased person. The bill would authorize a person's relative to seek an expunction. To the extent the bill would amend court procedures relating to expunctions, no significant effect on judicial workloads or fiscal implication to the State is anticipated. The bill would take immediate effect if the bill receives the vote of two-thirds of all members. Otherwise, the bill would take effect September 1, 2009.
