No significant fiscal implication to the State is anticipated.
The bill would add a subchapter to Chapter 401, Health and Safety Code, that would require the Department of State Health Services (DSHS) to establish and maintain a central registry of lasers or similar medical devices. The bill requires the executive commissioner of the Health and Human Services Commission to adopt rules related to inspections and maintenance of records. Persons violating the subchapter or a rule adopted under the subchapter would be liable to the state for a civil penalty of $1,000 per violation. The bill would take effect September 1, 2009. DSHS indicates that the central registry could be established by modifying existing databases. It is assumed that any costs to implement provisions of the bill could be absorbed within available resources.
