LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 4, 2009

TO:
Honorable Troy Fraser, Chair, Senate Committee on Business & Commerce

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2052 by Hilderbran (Relating to electric service reliability measures.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend Section 38.005(b) of the Utilities Code to authorize but not require that the Public Utility Commission (PUC) take appropriate enforcement action against a utility if any of the utility's feeders with 10 or more customers has had a System Average Interruption Duration Index (SAIDI) or System Average Interruption Frequency Index (SAIFI) average of more than 300 percent greater than the system average of all feeders during any two-year period. The bill would direct the PUC to consider certain issues regarding the feeder in determining appropriate enforcement action. The bill would require the PUC to adopt rules to conform existing rules to the bill's provisions.

The PUC anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
