LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 15, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2201 by Hughes (Relating to the designation of a structure on U.S. Highway 259 as the Trooper Todd Dylan Holmes Memorial Overpass.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require the Texas Department of Transportation (TxDOT) to design, construct, and erect highway markers designating a structure on U.S. Highway 259 that passes over State Highway 155 in Upshur County as the Trooper Todd Dylan Holmes Memorial Overpass, subject to Section 225.021 (c), Transportation Code.

Section 225.021 (c), Transportation Code, specifies that TxDOT is not required to design, construct, or erect the marker unless a grant or donation of funds is made to the department to cover the cost. Based on the analysis of TxDOT, it is assumed any duties associated with the implementation of the provisions of the bill could be absorbed within the agency's existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
