No significant fiscal implication to the State is anticipated.
The bill would amend Section 419 of the Government Code. The bill would limit the rule-making authority of the fire fighter advisory committee over the Commission on Fire Protection (TCFP). The bill would add the requirement that TCFP coordinate with state and federal agencies, including the Governor's Office, the Office of Homeland Security, and the Federal Emergency Management Agency in a declared state of emergency. The bill would transfer the Fire Department and Emergency Program to the Texas Forest Service by January 1, 2010, and would require the two agencies to develop a memorandum of understanding regarding the transfer. The bill would take effect September 1, 2009, except for the repeal of Government Code, Chapter 419, Subchapter C, which pertains to the Fire Department and Emergency Program. This section would be repealed January 1, 2010.
The Commission on Fire Protection anticipates no significant fiscal impact from the bill.
