LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 3, 2009

TO:
Honorable Tommy Merritt, Chair, House Committee on Public Safety

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2411 by Fletcher (Relating to the criminal penalty for unlawfully obtaining, lending, possessing, or using a driver's license or personal identification certificate.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code by defining the behavior associated with general violations of driver’s licenses and personal identification cards.  The bill would also enhance the punishment for the offense of false application in an application for an original, renewal, or duplicate driver ’s license or certificate from a Class A misdemeanor to a felony of the third degree.  The use of illegal license or certificate provision of the Transportation Code would be repealed.

The Department of Public Safety anticipates no fiscal impact from the bill to their agency.  It is assumed that the number of persons convicted under the enhancement provision of the bill would not result in a significant impact on the programs and workload of state corrections agencies.  It is assumed that the bill would not significantly affect the operations of state or local government.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
