LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 20, 2009

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2452 by Eiland (Relating to size limitations for certain physical education classes in public schools.), As Introduced

No fiscal implication to the State is anticipated.

Local Government Impact

School districts would be required to limit class size for physical education classes provided to students in grades kindergarten through four to no more than 22 students.  The bill would prohibit the commissioner of education from granting a waiver of the requirement. The Texas Education Agency anticipates that some school districts would incur costs to hire additional instructors for physical education classes to comply with the provisions of this bill. These costs would vary depending on the number of classes exceeding the 22-student limit and the number of new instructors that may be required to comply with the limit.  Some school districts could incur considerable costs to comply with the requirements.
