LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 2, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2537 by Creighton (Relating to the certification of sheriffs and deputy sheriffs to enforce commercial motor vehicle safety standards.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize a sheriff or a deputy sheriff in any county as eligible to apply for certification to enforce commercial motor vehicle safety standards. Under current statute, only a sheriff or deputy sheriff in certain counties are eligible for certification.

The Department of Public Safety (DPS) is responsible for certifying law enforcement officers for enforcing commercial motor vehicle safety standards. DPS recovers its costs from the municipality or county that employs the officers; therefore, there would be no fiscal impact to the state.

Local Government Impact

If a county sheriff or deputy sheriff were to seek certification, the county would incur costs associated with certification training. No significant fiscal implication to units of local government is anticipated.
