LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 19, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2676 by Davis, Yvonne (Relating to free trial offers on consumer goods and services.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code and requires a person who offers a consumer good or service for free during a trial period, to obtain the consumer’s written agreement to pay for the good or service at the end of the free trial period. The person may not charge for the good or service prior to obtaining the consumer’s written agreement.  A violation of this chapter is a deceptive trade practice under Chapter 17 of this Code. The Office of the Attorney General indicates that any additional work resulting from the enactment of the bill could be reasonably absorbed with current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
